Is your business website legal?

UK registered companies are required to include certain regulatory information on their websites and email footers. From the 1st January 2007 it became law to display this information. Failure to display the correct information now breaches the Companies Act 2006.

Each company should already list its registration number, place of registration and registered office address as part of the 1985 updates. This information already extends to business letters and the duty now extends to order forms, emails and other electronic documents. On a business website the requirement is that the information does not need to appear on every page. Many business websites already list this information on their contact page, about us or in the terms and conditions.

E-commerce legislation from 2002 requires that you display the name of your service provider, their registration number, place of registration and the geographical address where the service provider is located. Until now the E-commerce legislation has been ambiguous with many sites omitting the information. The general belief being that the regulations "do not apply to my site because I do not sell online".

Information required to be displayed

Your company address and registration number, VAT number if applicable, your geographical location (Scotland, England, Wales). If the business is a member of a trade association or professional body include details and membership numbers.

Prices on your website should be clear and state whether the prices include tax and delivery costs.

Service provider details, whether you are involved in e-commerce or not, you should provide the following minimum information, which must be easily, directly and permanently accessible: Your providers details, their email address, address and /or location, company registration number.
